ARTICLE 8 – RIGHT TO RESPECT FOR PRIVATE AND FAMILY LIFE
REF: HUMAN RIGHTS ACT 1998 > C42> SCHEDULE 1> PART 1> ARTICLE 8

1. Everyone has the right to respect for his private and family life, his home and his correspondence.

2. There shall be no interference by a public authority with the exercise of this right except such as is in accordance with the law and is necessary in a democratic society in the interests of national security, public safety or the economic well-being of the country, for the prevention of disorder or crime, for the protection of health or morals, or for the protection of the rights and freedoms of others.

This is directly lifted from legislation.gov.uk. How has Rohan posed a threat to any of the above? He hasn’t broken any laws, hurt anyone, threatened our national security, so why are these Public Authorities – our Local authority and ICB – repeatedly challenging his right to a private and family life again and again and again? Last time I looked being disabled wasn’t a crime.

Why are we being continually challenged to choose between Rohan living at home, where he is loved and thrives, and a more expensive residential placement where he may be neglected and alone for us to be able to have time off?

Why were they willing to pay just under half a million pounds a year to put him in a nursing home last November rather than meet his needs at home for significantly less? This just doesn’t make any logical or financial sense? I don’t believe it is to do with money or best interests, I think this is about power and control. Feel free to share your thoughts?

BTW Rohan hates having his picture taken, the minute I take my camera out, away goes the looking and smiling. Shame when he is such model material!
